What laws regulate the internet?

Australia is actually in the process of developing one of the most restrictive systems of internet censorship in the world. The present minister for communications, Mr Stephen Conroy has stated that he may push for legislation which will force ISPs to block certain content and record the usage of internet users on a routine basis. That this could be suggested in an open democratic country like Australia appears to be ludicrous but it is being seriously considered by the Australian Government at present although there is strong opposition to the proposal from internet industry civil libertarian groups. Nevertheless, in other aspects of the operation of the internet, there are certain elements of the law which apply. The national telecommunications legislation, the privacy laws and laws regarding electronic transactions all regulate the internet. Certain elements of the criminal laws of the states and territories of Australia also prevent people from broadcasting or viewing certain types of illegal content on the internet. However, it is unlikely that this would be relevant to most ordinary users of the internet.

The at present restricts ISPs in what data they can distribute and internet content hosts in what they can display or hold on their servers. If this content is objectionable” or “unsuitable for minors” a take down notice from the Australian Communications & Media Authority (“ACMA”) may be issued which compels the provider to remove the content pending hefty fines or possibly imprisonment is an individual is found culpable.
