In Australia, the system of residential tenancies is regulated by state laws in each state of Australia being New South Wales, Queensland, Victoria, Western Australia, South Australia and Tasmania. Taking New South Wales as an example, The Residential Tenancies Act 2010 and its associated Regulation commenced on 31 January 2011. The new Act follows a comprehensive review of the existing tenancy laws and includes more than 100 reforms. The changes include arrangements for rent payments, early termination by tenants, ‘no-grounds’ evictions, alterations by tenants, rent arrears, sub-letting, shared housing, security and tenancy databases.

We have two versions of this document. This is drawn as a part negotiable agreement which is to be signed by the holiday maker and returned to the property owner. The option is a ‘terms and conditions’ document which is non-negotiable and instead, sets standard terms which could, for example, be posted on a website. This document is in plain English but very comprehensive. Like all leases, this letting agreement has been designed primarily to protect the interest of the landlord.
